1. Acceptance of Terms

By accessing and using the MyImplantMatters mobile application ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms and Conditions, please do not use this App.

2. Description of Service

MyImplantMatters is a mobile application designed to help patients track and manage information about their medical implants, including but not limited to:

• Implant details and specifications
• Range of motion measurements
• Pain and discomfort tracking
• Emotional sentiment monitoring
• Activity logging
• Document storage and management

The App also provides caregivers with authorized access to manage implant information on behalf of patients.

3. Medical Disclaimer

IMPORTANT: This App is not intended to replace professional medical advice, diagnosis, or treatment.

The information provided through this App is for informational and tracking purposes only. You should never disregard professional medical advice or delay seeking medical treatment because of information you have read or received through this App.

The App does not:

• Provide medical diagnosis or treatment recommendations
• Replace the relationship between you and your healthcare provider
• Constitute a medical device or therapeutic product
• Guarantee any specific health outcomes

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or your implant.

4. User Accounts and Responsibilities

4.1 Account Creation

To use certain features of the App, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

4.2 User Responsibilities

You agree to:

• Provide accurate, current, and complete information when registering
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Use the App only for lawful purposes and in accordance with these Terms

4.3 Prohibited Uses

You may not:

• Use the App in any way that violates applicable laws or regulations
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App or servers connected to the App
• Use automated systems to access the App without authorization
• Reproduce, duplicate, copy, or exploit any portion of the App without permission

5. Caregiver Access

The App allows patients to grant access to their implant information to designated caregivers. By inviting a caregiver:

• You authorize the caregiver to view and/or edit your implant information according to the access level you specify
• You are responsible for managing caregiver access levels and revoking access when necessary
• You acknowledge that caregivers may have different levels of access (view-only or view and edit)
• You understand that changes made by caregivers will be reflected in your account

Patients maintain full control over caregiver access and can modify or revoke access at any time.

6. Data Usage and Analytics

6.1 Anonymized Data Analysis

To improve the App and provide valuable insights, we use anonymized and aggregated data from all users to:

• Calculate trends in implant health and deterioration patterns over time
• Analyze factors such as age demographics (without identifying individual users)
• Develop predictive models to help monitor implant health
• Provide essential feedback and recommendations to users
• Improve the accuracy of health tracking features

All data used for these purposes is anonymized, meaning it cannot be traced back to individual users. Personal identifiers are removed before any analysis is performed.

6.2 Feedback and Recommendations

The App uses our proprietary calculation methodology, "Implant Intelligence," which analyzes anonymized data to provide you with:

• Trend indicators showing how your measurements compare to anonymized population data
• Alerts when your data suggests potential issues based on anonymized comparison data
• General health insights based on aggregate anonymized patterns

These features are designed to supplement, not replace, professional medical advice.

7. Intellectual Property

The App and its original content, features, and functionality, including the proprietary "Implant Intelligence" calculation methodology, are and will remain the exclusive property of MyImplantMatters and its licensors. The App is protected by copyright, trademark, and other laws.

You may not use our trademarks, service marks, or logos without our prior written consent.

8. User Content

You retain ownership of any data and information you input into the App. By using the App, you grant us a license to:

• Store, process, and maintain your data in connection with providing the App
• Use anonymized and aggregated data from your account (with personal identifiers removed) for analytics and improvement purposes as described in Section 6

9. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

10. Data Storage and Security

We implement appropriate technical and organizational measures to protect your data. However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your data, we cannot guarantee absolute security.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYIMPLANTMATTERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, trojan horses, or the like that may be transmitted through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The App will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The App is free of viruses or other harmful components
• The results of using the App will meet your requirements

13. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

Upon termination, your right to use the App will cease immediately. You may terminate your account at any time by following the account deletion process in the App settings.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.

15. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which MyImplantMatters operates, without regard to its conflict of law provisions.
